Booking Policy
1. Definitions
"Service Provider" means Dwellerin Network Private Limited, incorporated under the Indian Companies Act, 1956, with its registered office at 666/B Nr. Acidwala Estate, Nr. Ramdev Estate, Rakhial Industrial Area, Ahmedabad, Gujarat 380023, and/or its subsidiaries, associated companies and authorised agents.
"Guest" means any person with whom the Service Provider contracts for the provision of Arrangement Services (accommodation providers such as Hostel, PG, Flats and any other accommodation type), or as agent for a Third Party Supplier.
References to "you", "your" are references to the Guest, authorised representatives of the Guest, or those for whom Accommodation is requested.
"Arrangement Services" means the Service Provider's services in recommending, booking, arranging, negotiating and reporting the supply of Accommodation Services by Third Party Suppliers, including Online Booking Services.
"Third Party Suppliers" means any third parties who supply Accommodation Services to the Guest.
"Accommodation Services" means accommodation, lodging or dwelling — Hostel, PG, Flats and other forms of accommodation and related services.
"Online Booking Services" means any system provided by the Service Provider to enable the Guest to make online bookings.
2. General
a) These conditions are incorporated into all contracts for Arrangement Services made by the Service Provider with the Guest, to the exclusion of all other terms, unless otherwise agreed in writing.
b) The Service Provider shall provide Arrangement Services and organise Accommodation Services as requested by the Guest and agreed from time to time.
c) When taking bookings, the Service Provider acts as a disclosed agent and the relevant Third Party Supplier is responsible for providing the Accommodation Services. The Service Provider is not responsible for any default, failure, loss, claim, cost, damage or injury arising from the acts or omissions of the Third Party Supplier.
d) By making a booking, the Guest enters into a legally binding contract with the relevant Third Party Supplier, subject to that supplier's terms and conditions.
e) No Guest or third party has any rights against the Service Provider except as set forth herein.
3. Fees and Payment
a) The Guest shall pay all costs, fees and taxes as mentioned on Homversity.com and as invoiced, in accordance with the payment terms set out.
b) The Service Provider reserves the right to request advance payment for Arrangement and/or Accommodation Services.
c) A convenience fee at the Service Provider's standard rate may be payable for costs incurred (e.g. credit/debit card or other transactional charges).
4. Booking Terms, Amendments or Cancellations
a) The Guest is responsible for the accuracy of all data supplied. Incorrect information may attract additional costs to correct.
b) The Service Provider reserves the right to charge an administration fee for amendments or cancellations where the refund policy terms are not met.
c) Accommodation Services may be subject to cancellation by the Third Party Supplier; the Guest is responsible for checking and complying with the specific change or cancellation terms.
d) The Guest is responsible for ensuring that all those making or arranging bookings on its behalf comply with its accommodation policy.
e) Where a purchase order or payment code is required, it is the responsibility of the relevant parties to provide it accurately. The Guest must pay in full for bookings made, including a refundable security deposit at the time of check-in where applicable.
5. Late Payments
If any sums due are not paid when due, without prejudice to other remedies, the Service Provider may at any time: a) suspend all or part of the Accommodation Services; and/or b) cancel any bookings for which payment is outstanding, with any cancellation fees for the account of the Guest.
6. Liability
a) The Service Provider's liability shall not exceed the total fees paid or payable by the Guest for the Arrangement Services concerned and the associated Accommodation Services.
b) The Service Provider shall not be liable for any indirect, special, consequential or punitive damages.
c) The Service Provider is not liable for any default or failure in supply by any Third Party Supplier, or any loss, claim, cost, damage or injury arising from their acts or omissions.
7. Insurance
The Host acknowledges it is prudent to put in place insurance for any loss, claim, cost, damage or injury in connection with the Accommodation Services. The Service Provider will make reasonable efforts to assist the Host in obtaining such insurance.
8. Waiver
No delay or failure to take action shall constitute a waiver by the Service Provider of any provision of these terms.
9. Variation
The Service Provider reserves the right to review and adjust fees without prior notice to account for inflation, increased charges, or changes to terms by Third Party Suppliers.
10. Data Protection
a) The Service Provider may collect and process personal data (names, contact and card details, dietary requirements) to make bookings with Third Party Suppliers.
b) The Guest consents to the transfer and storage of personal data for the purpose of making bookings.
c) A copy of the personal data held may be requested by the Guest at any time.
d) The Guest acknowledges that data may be transferred to Third Party Suppliers, whose use is governed by their own terms and outside the Service Provider's control.
11. Confidentiality
a) Each party undertakes to keep confidential all information concerning the business and affairs of the other obtained in connection with the services.
b) Confidential Information may be disclosed to parent/subsidiary companies and advisers, where required by law or a competent authority, or with the other party's prior written consent.
c) The Third Party Supplier must also maintain confidentiality of the terms of the agreement and any deal information.
12. Jurisdiction and Governing Law
These terms and any contracts between the Service Provider and the Guest are governed by the laws of the Union of India and subject to the jurisdiction of the courts of Ahmedabad, Gujarat, without prejudice to the Service Provider's right to seek recovery of sums due before any court of competent jurisdiction.
13. Force Majeure
Dwellerin Network Private Limited shall not be liable for any delay or failure to perform its obligations (other than payment) due to events beyond its reasonable control, including acts of God, war, riots, embargoes, strikes, lockouts, government action, delays in obtaining licenses, failure of network connections or power, fire or floods.
